A Lagos State magistrate court has docked a 50-year old man Suleman Buhari for allegedly raping a 13-year old girl. The accused is facing a two-count charge of unlawful canal knowledge and sexual assault preferred against him by the police.
The prosecutor, Sergeant Ajaga Agboko told the court that the accused who resides in the same vicinity as the victim, committed the alleged offence on October 5, 2016. He said the accused unlawfully had canal knowledge of the girl without her consent and also assaulted her sexually.
“The accused who hails from Mali, was arrested after a neighbour in the area who saw the girl entering the accused room and alerted her mother. When the mother of the girl and the neighbour got there, they saw the victim and the accused naked and were on the floor and then immediately he asked the girl to put on her cloths. “
“The victim later said that it was not the first time that the accused has had canal knowledge of her, that he started having canal knowledge of her way back in July this year when one day, after she came back from an errand for him, the accused shut the door and ordered her to pull off her clothes and then raped her.”
According to the prosecutor, the offence committed is punishable under sections 137 and 261 of the criminal law of Lagos State 2011.
However the accused pleaded not guilty to the charge against him, but he was denied bail.
The Magistrate, Mrs.O.Ogunbowale denied the accused bail but asked him to approach the High Court which has the power to grant bail. She asked the prosecutor to duplicate the case file and forward to the director of public prosecution for legal advice.
She, however, adjourned the case to November 9, for DPP’s advice.
